IMPACT KIDSTECH MC2025 LIMITED, trading as Impact Academies & Camps (“Impact A&C”, “we”, “us” or “our”), provides educational courses, coding programmes, camps, private tuition, online sessions and related services to students and their parents or legal guardians.
These Terms & Conditions (“Terms”) govern your access to and use of our website, mobile applications, portals, courses, programmes, camps and other services.
By registering for, purchasing or using any of our Services, you confirm that you have read, understood and agreed to these Terms.
Where the student is under 18 years of age, these Terms must be accepted by the student's parent or legal guardian, who accepts responsibility for the student's enrolment, payments and compliance with these Terms.

1. GENERAL
This Agreement governs your access to and use of:
a) the Impact Academies & Camps website and related online services;
b) the Impact Academies & Camps mobile software applications (“Mobile Applications”); and
c) private access portals for Impact Academies & Camps centres, students and parents (“Portal(s)”).
We use the terms “we”, “us”, “our” and “Impact A&C” to refer to IMPACT KIDSTECH MC2025 LIMITED trading as Impact Academies & Camps.
We use the term “Platform” to refer to the website, Mobile Applications and Portal(s), individually and collectively.
This Agreement applies broadly to your access to and use of the Platform and to all courses, lessons, programmes, camps, tuition and other services provided by Impact Academies & Camps (“Services”).
By using the Platform or purchasing or using our Services, you agree to be bound by these Terms.
If you do not agree to these Terms, you should not use the Platform or purchase or use our Services.
You represent that you have the legal capacity and authority to enter into this Agreement and make reservations or purchases.
Where you are acting on behalf of a child, you confirm that you are the child's parent or legal guardian or are otherwise legally authorised to act on the child's behalf.
Certain Services may be subject to additional terms. Any such additional terms will form part of this Agreement.
In the event of a conflict between these Terms and additional terms specifically applicable to a particular Service, the additional terms will apply only to that Service to the extent of the conflict.
We reserve the right to amend these Terms from time to time. Updated Terms will be published on our Platform and will apply to future purchases and use of our Services, subject to applicable law.

2. ADMISSION
  1. Admission to Impact Academies & Camps is subject to availability of the relevant centre, tutor, course, programme or camp and the suitability of the student.
  2. Impact Academies & Camps may refuse admission to a student where we reasonably consider that the course or environment is unsuitable for the student or where this is reasonably necessary to maintain discipline, safety and the wellbeing of students, staff or other persons.
  3. Impact Academies & Camps may require an assessment session before enrolling a student on a course and may charge a fee for this service where applicable.
  4. Attendance at a taster or trial session does not guarantee a place on a course.
  5. Due to limited spaces, places may be allocated on a first-come, first-served basis. We reserve the right to allocate a place to another student where the required payment has not been received.
  6. A place on a course is only confirmed once the required payment has been received or, where applicable, the required registration or enrolment fee has been received.
  7. Impact Academies & Camps reserves the right to cancel or reschedule a confirmed booking where reasonably necessary, including due to overbooking, tutor availability, operational requirements or circumstances beyond our reasonable control.
  8. No student may be admitted until the required Enrolment Form has been completed and the parent or legal guardian has acknowledged and accepted these Terms and the applicable payment has been made.
  9. An enrolment fee of €55.00 may apply where stated at the time of booking.

3. FEES AND PAYMENT
  1. Fees are payable in accordance with the payment option selected at the time of booking.
  2. Where a subscription or recurring payment plan is selected, payments will be processed automatically through Stripe using the payment method provided by the parent or legal guardian.
  3. The amount, frequency and applicable payment dates will be displayed during the payment process.
  4. Where a monthly recurring subscription is selected, the recurring payment will normally be collected on the same calendar day on which the initial subscription payment was made.
For example, if the initial payment is made on 4 September, subsequent monthly payments will normally be collected on the 4th of each month.
  1. Where a three-month recurring payment arrangement is selected, payments will be collected according to the three-month frequency displayed during the payment process.
  2. Enrolment, registration and other applicable fees may be processed separately from the subscription payment.

4. PAYMENT IN FULL
  1. Where a full-payment option is available, the full amount must be paid in accordance with the payment instructions provided.
  2. Where applicable, payment in full may be made through a Stripe Payment Link or by bank transfer.
  3. Any discount offered for payment in full is subject to the specific terms communicated at the time of booking.
  4. Where a nine-month programme is paid in full, the payment will normally be processed as a one-time payment rather than as a recurring subscription.

5. MONTHLY OR THREE-MONTH PAYMENT PLANS
  1. Monthly fees are paid in advance through a Stripe subscription.
  2. Where a three-month recurring payment plan is selected, the applicable amount will be charged automatically according to the payment frequency displayed at checkout.
  3. By selecting a recurring subscription, you authorise Impact Academies & Camps to process future payments automatically using the payment method provided.
  4. The recurring payment will continue until the subscription is cancelled in accordance with these Terms.

6. REFUNDS AND CANCELLATIONS
  1. All payments made for courses, programmes, camps, subscriptions, lessons, registration fees and other Services provided by Impact Academies & Camps are non-refundable, except where a refund is required by applicable Irish law.
  2. Once a booking has been confirmed and payment has been made, the payment is considered final.
  3. We do not provide refunds where a parent, legal guardian or student:
  • changes their mind;
  • decides not to attend;
  • is unable to attend;
  • misses a lesson, session or camp day;
  • withdraws from a course, programme or camp after payment;
  • does not use all lessons or sessions included in a package or subscription;
  • cancels for personal reasons; or
  • otherwise chooses not to use the Services purchased.
  1. For camps, courses and other activities scheduled for a specific date or period, cancellation by the customer does not entitle the customer to a refund, subject to any mandatory consumer rights that cannot legally be excluded.
  2. No refunds or pro-rata reductions will be provided for unused lessons, missed classes or unused portions of a subscription.
  3. No discounts or refunds will be provided for missed classes.
  4. Registration, enrolment and joining fees are non-refundable, except where a refund is required by applicable law.
  5. For subscription plans, cancellation will prevent future recurring payments in accordance with these Terms. Cancellation does not create a right to a refund of payments already made.
  6. Where a customer has paid in advance for a three-month or nine-month period and subsequently cancels, the customer will not receive a refund or pro-rata reimbursement for the unused portion of the prepaid period, except where required by applicable law.
  7. Where applicable, the customer may continue to access the Services for the remainder of the prepaid period following cancellation, subject to the terms of the applicable programme.
  8. Nothing in these Terms is intended to exclude or restrict any consumer right or legal remedy that cannot legally be excluded or restricted under Irish law.

7. CANCELLATION OF SUBSCRIPTIONS
  1. Parents or legal guardians may request cancellation of a subscription by notifying Impact Academies & Camps in writing.
  2. Parents may also cancel an automated subscription through Stripe where this functionality is available.
  3. Cancelling a Stripe subscription does not remove the requirement to notify Impact Academies & Camps of the intention to withdraw.
  4. Cancellation requests should be submitted at least 14 days before the next scheduled payment, unless otherwise agreed or required by applicable law.
  5. Cancellation will stop future recurring payments after the applicable cancellation period.
  6. Payments already processed are non-refundable, subject to applicable law.
  7. Lessons or Services already paid for may continue to be used during the applicable paid period, subject to availability and the applicable programme rules.
  8. Parents are responsible for providing a valid email address and keeping their contact details up to date so that payment and service-related communications can be received.

8. HOW TO CANCEL
Withdrawal from a course or programme must be submitted in writing.
Cancellation may be submitted:
  • by email to cork@impactacademiesie.com;
  • by post to The Carraig Centre, Old Fort Road, Ballincollig, Cork, Ireland, P31 PV20; or
  • by written notice at the relevant Impact Academies & Camps branch.
A cancellation notice is not effective until it has been received by Impact Academies & Camps.
We aim to respond to cancellation requests within 48 hours.
If you do not receive confirmation by email within 48 hours, you should contact us by telephone on +353 (85) 110 6075.

9. WITHDRAWAL AND RE-ENROLMENT
  1. If a parent or student withdraws from a course and later wishes to re-join, Impact Academies & Camps reserves the right to require payment for any sessions missed between the withdrawal and re-enrolment where applicable.
  2. A new enrolment may be subject to availability and the applicable prices and terms at the time of re-enrolment.
  3. A student may not automatically retain their previous place following withdrawal.

10. UNPAID PAYMENTS
  1. If a parent or student stops making required payments, Impact Academies & Camps may withdraw the student from the course.
  2. Impact Academies & Camps reserves the right to seek payment of any outstanding amounts relating to Services already provided.
  3. Where an agreed payment plan is not maintained, the outstanding balance may become immediately payable where permitted by law.
  4. We reserve the right to cancel a student's place where required payments have not been received.

11. PRICE PACKAGES
We offer subscription packages which may include:
  • Monthly – 4 lessons
  • 3 Months – 12 lessons
  • 9 Months – 36 lessons
All prices are displayed on our website or during the booking process and may be subject to change for future bookings.
For three-month and nine-month subscriptions, the following payment options may be available:
  • monthly instalments; or
  • payment in full.
The specific price and payment schedule applicable to your booking will be displayed before payment.

12. START DATE
  1. Subscriptions must normally be completed before the start of the course.
  2. The course start date should normally be within one week of the first payment unless otherwise agreed.
  3. If payment is made during a period when coding lessons are not being held, the start date may be moved to the first available lesson date when classes resume.
  4. Impact Academies & Camps reserves the right to withdraw a student where required payments have not been made.
  5. It is the customer's responsibility to monitor their recurring payments and ensure that the payment method remains valid.

13. SUBSCRIPTIONS AND RECURRING AUTOMATED PAYMENTS
  1. By setting up a subscription through Stripe, you authorise Impact Academies & Camps to initiate the payment or series of payments necessary to pay for the subscription selected.
  2. The amount and payment frequency will be displayed before the initial payment is completed.
  3. By completing the subscription purchase, you acknowledge that the payment method provided may be charged automatically according to the selected subscription.
  4. The recurring payment continues until the subscription is cancelled in accordance with these Terms.
  5. The default payment frequency may be monthly or every three months depending on the subscription selected. The exact frequency will always be displayed during the payment process.
  6. Recurring payments will normally be collected on the same calendar day as the initial payment, subject to Stripe processing and the applicable subscription configuration.
  7. Students or their parent/legal guardian may receive payment reminders from Stripe or Impact Academies & Camps before an upcoming payment.
  8. The amount to be charged will be displayed when setting up the subscription.
  9. If you wish to change your subscription, you must contact Impact Academies & Camps by email and confirm the preferred package.
  10. Any subscription change will be subject to availability and confirmation by Impact Academies & Camps.
  11. Where a new subscription is agreed, the existing subscription may be cancelled and the new subscription activated according to the agreed effective date.
  12. Any unused prepaid lessons will be dealt with in accordance with the applicable package and any arrangement confirmed by Impact Academies & Camps.

14. PAYMENT AUTHORISATION AT CHECKOUT
Where a recurring subscription is purchased through Stripe, the customer will be informed during checkout that the selected payment is recurring.
The customer must review:
  • the selected subscription;
  • the price;
  • the payment frequency;
  • the recurring payment amount; and
  • the applicable Terms & Conditions
before completing the purchase.
Where an acknowledgement checkbox is provided at checkout, the customer must actively confirm acceptance before completing the purchase.
The customer should not complete the purchase if they do not agree to the recurring payment arrangement or these Terms.

15. METHODS OF PAYMENT
Payment may be made by:
  • Credit Card;
  • Debit Card;
  • Stripe Payment Link; or
  • Direct Bank Transfer where this option has been specifically provided.

16. LATE FEES
  1. Where a subscription payment remains unpaid and we are unable to collect the payment for eight consecutive days, a late fee of €20.00 may be added to the customer's account.
  2. Late fees may be applied to each missed instalment.
  3. For example:
  • 1 month in arrears = €20.00 late fee;
  • 2 months in arrears = €40.00 late fees;
  • 3 months in arrears = €60.00 late fees.
  1. Where permitted by applicable law, partial months may be treated in accordance with the applicable payment policy.
  2. We reserve the right to suspend or cancel access to Services where payments remain unpaid.

Unless otherwise agreed in writing, applicable late fees may continue to apply to overdue payments.

18. ONLINE SESSIONS
  1. Online sessions are sessions delivered outside Impact Academies & Camps premises.
  2. Students and their parents/guardians are responsible for ensuring access to the required hardware and software, including computers, laptops, monitors, applications, programmes, internet connections, headsets and microphones.
  3. All costs associated with such equipment, software or internet access are the responsibility of the student or parent/guardian.
  4. Impact Academies & Camps is not responsible for the cost of equipment, software or internet services required to participate in online sessions.
  5. Students and their parents/guardians are responsible for ensuring that a stable internet connection is available.
  6. Students should participate from a suitable, quiet environment free from unnecessary distractions.
  7. Parents may need to be available to assist younger students with technical difficulties.
  8. Impact Academies & Camps tutors or representatives may mute or remove a student from an online classroom where they reasonably consider this necessary for the benefit, safety or proper operation of the class.

19. PRIVATE TUITION
  1. A private tuition session may be rescheduled without charge where at least 24 hours' notice is provided.
  2. Notice must be submitted in writing to cork@impactacademiesie.com and must include the correct student and session details.
  3. Failure to provide at least 24 hours' notice may be treated as a “No Show” and the session may count towards the student's paid hours.
  4. Where a student has up to two No Show records, they may continue the course subject to the applicable programme requirements.
  5. Additional No Show records may require makeup sessions.
  6. A €25 re-booking fee per missed class may apply where a makeup or replacement session is requested following a No Show.

20. AUTHORITY, SUSPENSION AND EXPULSION
  1. Impact Academies & Camps reserves the right to take reasonable steps necessary to maintain discipline and protect the safety and wellbeing of students, staff and equipment.
  2. We may suspend or remove a student where their attendance, work or behaviour is reasonably considered unsatisfactory or where their conduct adversely affects staff or other students.
  3. Where a student is suspended or removed due to behaviour or other circumstances attributable to the student, fees already paid will not be refunded, except where required by applicable law.
  4. We may seek payment for Services already provided and any other outstanding amounts that are legally due.

21. TRIAL LESSONS
  1. We may offer a one-hour or two-hour free trial lesson for children between the ages of 5 and 17.
  2. Students outside this age range may be required to pay a trial lesson fee of €25.
  3. A trial lesson must be booked by an adult parent or legal guardian who is responsible for the child during the session.
  4. Each child is entitled to one free trial lesson only.
  5. Additional trial lessons may be available for a fee of €25.
  6. We may cancel or reschedule trial lessons due to instructor availability, technical problems or other operational reasons.
  7. We may cancel or decline a trial lesson request where we reasonably consider the request unsuitable, including in cases involving spam or other misuse of our booking system.
  8. Parents may reschedule a trial lesson once without charge provided at least 24 hours' notice is given.
  9. Trial lessons may be recorded for quality assurance and security purposes.
  10. Trial lesson recordings may normally be retained for up to 14 days, although some recordings may need to be retained for longer where reasonably necessary for quality assurance, security, legal or other legitimate purposes.
  11. Parents or legal guardians may request deletion of a recording by contacting customer support. Any request will be considered in accordance with applicable data protection law and any applicable legal or legitimate retention requirement.
  12. Materials, content and resources provided during a trial lesson remain the intellectual property of Impact Academies & Camps and may not be copied, distributed or commercially used without prior permission.
  13. We take reasonable steps to provide a safe and appropriate learning environment. Nothing in these Terms excludes liability that cannot legally be excluded.
  14. Participation in a trial lesson may involve ordinary risks associated with educational activities, and parents/guardians remain responsible for appropriate supervision where required.
  15. We may suspend or terminate access to a trial lesson service where these Terms are breached or where reasonably necessary for operational, safety or security reasons.

22. PROMOTIONS AND OFFERS
  1. Impact Academies & Camps may occasionally offer special promotions, discounts or free lessons.
  2. Promotional offers may be available for a limited period and subject to limited availability.
  3. The applicable promotion, eligibility requirements, deadlines and conditions will be communicated at the time of the offer.
  4. Unless otherwise stated, promotions cannot be combined with other offers.
  5. We reserve the right to withdraw or modify promotional offers subject to applicable law and any specific terms already agreed with a customer.

23. PHOTOGRAPHY AND VIDEO RECORDING
  1. From time to time, Impact Academies & Camps may take photographs, videos, audio recordings, interviews, written reviews or feedback involving students.
  2. Such material may be used for advertising and marketing purposes, including on websites, social media, promotional materials and leaflets.
  3. Where consent is required, we will seek and process consent in accordance with applicable data protection law.
  4. Parents or legal guardians who do not wish their child to be included in promotional photography or video should contact:

  1. Any request should include:
  • Name of the child;
  • Course booked; and
  • Date of booking.

24. PERSONAL PROPERTY
  1. Students are advised not to bring valuable or unnecessary personal belongings to classes, camps or other activities.
  2. Impact Academies & Camps is not responsible for loss or damage to personal property except where liability cannot legally be excluded.
  3. Students remain responsible for their own belongings while attending our Services.

25. PROCESSING OF PERSONAL INFORMATION
Impact Academies & Camps will process personal information fairly and lawfully and in accordance with applicable data protection legislation.
We may process personal information where:
  1. processing is permitted or required by law;
  2. we have a lawful basis for processing, including where appropriate consent has been provided;
  3. processing is necessary to provide our Services or perform our contractual obligations;
  4. processing is necessary for legitimate business purposes where permitted by law; or
  5. processing is required by a court, legal authority or other competent body.
Our Privacy Policy provides further information about how personal data is collected, used and protected.

26. KEEPING PERSONAL INFORMATION SAFE AND ACCURATE
  1. Impact Academies & Camps takes reasonable measures to protect personal information held in computer systems, drives and paper records against unauthorised or unlawful processing and against accidental loss, destruction or damage.
  2. We may receive information about customers and students from third parties or share information with third parties where permitted or required by law.
  3. Third parties who process personal data on our behalf may be required to comply with applicable data protection requirements.
  4. We aim to collect and retain personal information that is relevant and necessary for our business and legal purposes.
  5. We take reasonable steps to keep personal information accurate and up to date where appropriate.

27. DATA SHARING
  1. Impact Academies & Camps will only share personal data where there is a lawful basis for doing so.
  2. Personal data may be shared with service providers, payment processors, professional advisers, regulators, public authorities or other third parties where necessary and legally permitted.
  3. Where required, appropriate contractual and security measures will be used to protect personal data.

28. RETENTION OF INFORMATION
  1. We retain personal information only for as long as reasonably necessary for the purposes for which it was collected, including legal, accounting, administrative, contractual and regulatory requirements.
  2. Certain information may need to be retained for longer where required by law or reasonably necessary to establish, exercise or defend legal claims.

29. FORCE MAJEURE
Impact Academies & Camps will not be responsible for delay or failure to perform its obligations where such delay or failure results from circumstances beyond our reasonable control.
Such circumstances may include, but are not limited to:
  • acts of war;
  • acts of God;
  • natural disasters;
  • earthquake;
  • riot or civil disturbance;
  • fire;
  • industrial action or labour disputes;
  • significant staff shortages;
  • internet or telecommunications interruption;
  • technical failures;
  • cybersecurity incidents;
  • infrastructure failures;
  • government restrictions; or
  • other circumstances beyond our reasonable control.
Where reasonably possible, we will take appropriate steps to minimise disruption and communicate material changes to affected customers.

30. DISPUTE RESOLUTION AND JURISDICTION
  1. We encourage customers to contact us first so that we can attempt to resolve any complaint or dispute informally.
  2. These Terms and the relationship between the customer and Impact Academies & Camps are governed by the laws of Ireland, subject to any mandatory consumer protections that apply.
  3. Any dispute resolution provision will be subject to applicable Irish consumer law and any rights that cannot legally be excluded or restricted.
  4. Nothing in these Terms prevents a consumer from exercising any statutory right to bring a claim before a competent court or authority where such right cannot legally be excluded.

33. ACCEPTANCE OF THESE TERMS
Where a student is under 18 years of age, the parent or legal guardian is responsible for reviewing these Terms before completing the booking or payment.
By completing the enrolment, booking or payment process, the parent or legal guardian confirms that:
  • they have read these Terms;
  • they understand the payment and cancellation arrangements;
  • they understand that payments for Services are generally non-refundable, subject to applicable law;
  • where applicable, they understand that the selected subscription involves recurring automated payments;
  • they have provided accurate information; and
  • they agree to be bound by these Terms.

34. RECURRING PAYMENT ACKNOWLEDGEMENT
Where a customer purchases a recurring subscription through Stripe, the following acknowledgement should be presented during the checkout process:
“I authorise Impact Academies & Camps to automatically charge my selected payment method for the subscription selected above. I understand that the amount and payment frequency displayed above will be charged automatically until the subscription is cancelled in accordance with the Terms & Conditions.”
The customer should actively acknowledge this statement before completing the recurring subscription purchase where the checkout process provides such functionality.

IMPORTANT CHECKOUT NOTICE
For recurring Stripe subscriptions, the Terms & Conditions should be available to the customer before payment.
The checkout process should clearly identify:
  • the subscription selected;
  • the amount payable;
  • the recurring payment amount;
  • the frequency of recurring payments;
  • that the payment will be collected automatically; and
  • the cancellation terms.
Where Stripe provides a checkbox or acknowledgement option, the customer should actively confirm the recurring payment arrangement and acceptance of the applicable Terms & Conditions before completing the purchase.
